Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers via the online shop of Bonaf GmbH under the brand Widale.

A consumer, as defined by these GTC, is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

The contract language is German.

3. Offer, Products, and Availability

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

Illustrations, colors, and representations of products on the website may deviate slightly from the actual product depending on the device, display settings, and technical conditions. The respective product description is decisive.

We reserve the right to change the type, scope, and availability of the offered products at any time.

If a product ordered is not available, we will inform the customer immediately. Any payments already made will be refunded without delay in this case.

We reserve the right to refuse orders in quantities unusual for a household or orders where commercial resale is likely based on the circumstances.

4. Conclusion of Contract

By clicking the button "Buy now", "Order with obligation to pay" or a similar unambiguous button, the customer submits a binding offer to conclude a purchase contract.

Before sending the order, the customer can check and correct their entries at any time.

The contract is only concluded when we accept the order by means of an order confirmation email or by shipping the goods.

The automated confirmation of receipt of the order does not yet constitute acceptance of the contract offer, unless explicitly stated otherwise therein.

We are entitled to refuse orders within 30 days of receipt, particularly if:

  • the goods are not available,
  • there are indications of misuse, fraud, or impermissible orders,
  • previous payment obligations from contractual relationships with the customer have not been fulfilled,
  • or orders are clearly not intended for private end-use.

5. Prices and Shipping Costs

All prices are quoted in Euros and include the statutory value-added tax.

In addition to the stated prices, shipping costs may apply. These will be displayed separately to the customer during the ordering process before the order is submitted.

Despite careful checking, price errors cannot be completely excluded. Should there be an obvious error in the pricing, we are entitled to refuse the order. Any payments already made will be refunded immediately in this case.

6. Payment Terms

Payment is made using the payment methods offered in the online shop. These may include, in particular:

  • Credit card
  • PayPal
  • Klarna
  • Shopify Payments
  • Instant payment / other payment methods offered at checkout

The payment instrument will be charged according to the processes applied by the respective payment service provider.

If a payment method processed via external payment service providers is selected, their terms and conditions and data protection provisions also apply.

We reserve the right not to offer individual payment methods in specific cases.

If the customer defaults on payment, the statutory regulations apply.

7. Delivery, Shipping, and Transfer of Risk

Delivery will be made to the delivery address specified by the customer.

The respective applicable delivery times are stated in the online shop or during the order process.

Unless otherwise agreed, delivery will take place within 30 days of the conclusion of the contract.

If delivery is not possible for reasons for which we are not responsible, because the goods are not available despite proper hedging transactions, we are entitled to withdraw from the contract. In this case, we will inform the customer immediately and refund any payments already received without delay.

For consumers, the risk of accidental loss and accidental deterioration of the goods passes to the customer or a person authorized to receive them only upon delivery of the goods.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Transport Damage

If goods are delivered with obvious transport damage, the customer is requested to report such damage to the delivery person immediately, if possible, and to contact us without delay.

Failure to report or contact us has no consequences for the customer's statutory warranty rights, but it helps us to assert our own claims against the carrier or transport insurance.

10. Right of Withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts.

Details can be found in the separate Cancellation Policy, which is part of the contract.

11. Returns / Returns Process

Regardless of statutory rights, the following applies to returns:

Returns should ideally be announced in advance by email to info@widale.de so that we can assign the return organizationally. This is not a prerequisite for the effective exercise of the statutory right of withdrawal.

The goods must be securely packaged and returned to the return address communicated by us.

Unless otherwise stipulated in the cancellation policy or on the website, the customer bears the direct costs of returning the goods.

The refund will be made in accordance with the statutory provisions via the same payment method that was used for the original transaction, unless expressly agreed otherwise.

12. Pre-orders / Pre-Orders

If products in the online shop are explicitly marked as pre-order, pre-order or with a similar indication, this means the purchase of a product that is not yet immediately available at the time of order.

In this case, the estimated shipping period or delivery date will be indicated in the product description or during the ordering process.

For pre-orders, delays may occur, particularly due to production, supply chain, or logistical circumstances. We will inform the customer about significant delays.

The customer's statutory rights, particularly in the event of unreasonable delivery delays, remain unaffected.

13. Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods,

  • that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive,
  • or that are clearly tailored to the personal needs of the consumer.

This applies in particular to personalized or custom-made products.

In all other respects, the statutory exceptions to the right of withdrawal apply.

14. Vouchers and Discount Codes

If vouchers, promotional codes, or discount codes are offered in the online shop, these are only valid under the respective specified conditions.

Cash payment of vouchers or discount values is excluded, unless otherwise mandatorily prescribed by law.

Vouchers and discount codes can only be redeemed within the specified period and within the scope of the respective offer. Subsequent crediting to already completed orders is excluded.

15. Customer Account

If we offer the possibility to set up a customer account, the customer is obliged to provide the data requested during registration truthfully and completely.

The customer is obliged to treat access data confidentially and to protect it from third-party access.

The customer is responsible for activities carried out via the customer account, provided that they are responsible for the misuse.

We reserve the right to temporarily block or permanently delete customer accounts if there are indications of misuse, false information, or violations of these GTC.

16. Warranty

The statutory liability for defects applies.

If there is a defect in the purchased item, the customer is entitled to subsequent performance within the framework of the statutory provisions, i.e., at their option, to the rectification of the defect or the delivery of a defect-free item, unless the chosen type of subsequent performance is disproportionate.

If subsequent performance fails, is unreasonable, or is refused, the customer may, in accordance with the statutory provisions, reduce the purchase price, withdraw from the contract, or demand damages.

The limitation period for statutory claims for defects for new goods is two years from the delivery of the goods.

17. Liability

We are liable without limitation:

  • in case of intent and gross negligence,
  • in case of culpable injury to life, body or health,
  • according to the provisions of the Product Liability Act,
  • as well as in all other cases where statutory mandatory liability is provided for.

In case of slight negligence, we are only liable for the violation of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer can regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.

In all other respects, liability for slight negligence is excluded.

18. Intellectual Property

All content of the website, in particular texts, images, photos, graphics, logos, designs, product presentations, videos and other content, are protected by copyright, trademark or other legal rights.

Any use, reproduction, distribution, public accessibility or other exploitation outside the statutory limits requires our prior express written consent.

19. Misuse of the Website

Use of the website is permitted exclusively for lawful purposes.

In particular, the following are prohibited:

  • disrupting or impairing the website or technical systems,
  • misusing forms, accounts, or order functions,
  • circumventing technical protection measures,
  • using automated systems to extract content, unless legally permitted,
  • as well as any use that infringes our rights or the rights of third parties.

We reserve the right to take appropriate measures in case of violations, in particular to restrict access to the website or customer accounts.

20. Dispute Resolution

The European Commission provides a platform for online dispute resolution.

We are not obliged and unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

21. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as mandatory legal provisions of the state in which the consumer has their habitual residence are not restricted thereby.

22. Final Provisions

Should individual provisions of these GTC be or become wholly or partially ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected.
